  • Can I dock exempt personnel’s pay in hourly increments?

    No. To do so would threaten the exemption. Employers may, however, permit employees to draw from paid leave banks (e.g., vacation, sick leave, etc.) in less than full-day increments without compromising the exemption. Please note there is a also small exception for exempt employees taking intermittent leave under the FMLA.
